1 Scope / Identity of the provider
These General Terms and Conditions apply to all contracts that you conclude with us, Heinrich Salm KG, Printzstr. 5, 76139 Karslruhe, E-Mail: haiber@salm-karlsruhe.de, Tel.: 0721-96404-31, via our online shop at www.salmgastro.de complete.
2 Definitions / Applicable law
2.1 A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
2.2 An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
2.3 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in a member state of the European Union, this choice of law shall not apply to the extent that it deviates from mandatory provisions of the state of your habitual residence, from which no deviation may be made by agreement.
3 Contract language / storage of the contract text
3.1 The contract language is German.
3.2 When ordering via the shopping cart function of our online shop, you can print or electronically save the complete contractual terms (order details, general terms and conditions, and cancellation policy) using your browser's print function before completing the order. They will be sent to you again via email with the confirmation of receipt of your order. Beyond this, the contract text will not be saved by us and you will no longer be able to access it.
3.3 If you send us inquiries regarding the conclusion of a contract via other contact options provided on our online shop (e.g. by email), you will receive the complete contractual terms and conditions by email so that you can print them out and save them electronically.
4 Conclusion of the contract / Correction of input errors
4.1 The offers published by us represent binding offers to conclude a contract.
4.2 To conclude a contract via our online shop, you need your own customer account.
4.3 You can place a binding order for the goods offered in our online shop using the "Shopping Cart" function. To do so, simply place the desired item in the shopping cart using the corresponding button in the respective offer. You can place multiple items in the shopping cart one after the other. You can access your shopping cart using the corresponding button in the navigation bar. You can make any desired changes there or initiate the ordering process by clicking the "Proceed to Checkout" button.
If you are not already logged into your customer account, you will then be asked to do so or, if you do not yet have your own customer account, to create one.
Then enter your shipping information and select your preferred payment method. You can review your selections and entries at any time using your browser's "Back" function and correct any errors, or cancel the order process by closing the browser window. In addition, all selections and entries will be displayed again on the order overview page, where you can also change and correct them using the corresponding buttons.
By submitting your order via the "order with payment" button, you declare your binding acceptance of our offer, which concludes the contract.
4.4 Requests to conclude a contract that you send to us via other contact options provided in our online shop (e.g., by email) are non-binding. We will then submit a binding offer, which you can accept within one week, unless otherwise stated in the offer.
5 Prices and payment terms
5.1 The prices stated in our offers are total prices and include statutory VAT.
5.2 Any shipping costs that may be incurred are not included in the total price. The applicable shipping costs and their amount can be viewed via a corresponding button on our website and, if applicable, on the respective product page. If additional shipping costs are incurred, they will also be listed separately during the ordering process.
5.3 For deliveries to countries outside the European Union, additional costs (e.g. taxes, customs duties) may arise, which you must bear and pay directly to the relevant authority.
5.4 The following payment methods are available to you for payment, subject to the terms and conditions specified therein:
Klarna Instant Bank Transfer: To make a payment via Klarna Instant Bank Transfer through the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you need a bank account activated for online banking. After entering your details for online access to your bank account, Klarna will perform a coverage check and, upon confirmation of the payment, transmit the transfer order to your bank. Your account will be debited immediately upon completion of the payment.
Klarna Invoice: You can pay by invoice through the payment service provider Klarna (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm). Klarna's terms of use apply, available at: https://www.klarna.com/de/agb/To use the Klarna invoice payment method, you need your own Klarna account. Payment also requires a positive credit check prior to payment. To process the payment, we assign our claim against you to Klarna. You then pay the invoice amount directly to Klarna after receiving the goods from us within the agreed payment period.
Klarna Sofort: You can make payments via instant bank transfer, SEPA direct debit, or credit/debit card through the payment service provider Klarna (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm). Klarna's terms of use apply, available at: https://www.klarna.com/de/agb/To use the Klarna direct debit payment method, you need your own Klarna account. Payment also requires a positive credit check prior to payment. When paying via SEPA direct debit or credit/debit card, your account will be debited after the goods have been dispatched. When paying via SEPA direct debit, you will be notified separately by email in advance of the time your account will be debited. When paying via Sofortüberweisung, your account will be debited immediately upon completion of the payment.
Klarna Installment Purchase: You can pay by installment purchase through the payment service provider Klarna (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm). Klarna's terms of use apply, available at: https://www.klarna.com/de/agb/There you will also find the European Standard Information for Consumer Credit. To use the Klarna Installment Purchase payment method, you need a Klarna account. Payment also requires a positive credit check. For payment by installment purchase, we assign our claim against you to Klarna.You then pay the invoice amount directly to Klarna within the payment terms agreed in Klarna's terms of use.
Credit/Debit Card: When paying with a credit or debit card, the transaction is carried out immediately after the contract is concluded and your account is debited.
Invoice: If you choose to pay by invoice, please transfer the agreed invoice amount to our specified account within 7 days of receiving the invoice. Payment by invoice is only available upon request.
Prepayment: With the prepayment payment method, you pay the invoice amount after conclusion of the contract and the payment request by bank transfer to our account specified in the payment request. The goods will be shipped within the agreed delivery period after your payment instruction.
Apple Pay: With Apple Pay, you can make payments via credit, debit, or prepaid cards through the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA. To do so, you need a device enabled with Apple Pay and must visit our website using the Safari browser. After selecting your payment method and verifying your identity and payment confirmation, your account will be charged immediately upon completion of the transaction.
Google Pay: With the Google Pay feature, you can make payments via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland, by credit or debit card or PayPal. You will need a Google account for this. After selecting your payment method, providing appropriate authentication, and confirming the payment, your account will be debited immediately upon completion of the transaction, unless otherwise specified in the terms of use for the selected payment method (e.g., SEPA direct debit via PayPal).
5.5 For payment methods where we make advance payments, i.e. where the goods are sent to you before you have made payment, we reserve the right to carry out a prior credit check and to refuse the selected payment method in the event of a negative credit check.
5.6 Unless otherwise agreed above, any payment claims against you arising from the concluded contract are due for payment immediately.
6 Delivery conditions
You can view the delivery conditions applicable to the respective offer (delivery methods, applicable delivery costs and delivery date) via a corresponding button on our website or on the product page of the offer.
7 Warranty rights
Your warranty rights in the event of defects are governed by statutory provisions.

8.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from and in connection with the contract concluded with us is our registered office. The same applies if you do not have a general place of jurisdiction in a member state of the European Union or, in the event of legal action against you, your place of residence or habitual abode is not known at the time the action is brought.
